Terms and Conditions – Now or Never Suppz
1. General
1.1 These terms and conditions apply to all agreements between Now or Never Suppz and the customer.
1.2 By placing an order, the customer agrees to the delivery and payment terms.
1.3 Now or Never Suppz reserves the right to amend the delivery and payment terms at any time. However, the terms in effect at the time of ordering remain applicable to that order.
1.4 These terms apply to every agreement between Now or Never Suppz and the customer, unless expressly agreed otherwise in writing.
1.5 These terms also apply to agreements in which Now or Never Suppz engages third parties for execution.
1.6 The goods and/or services offered are clearly, truthfully, and as fully described as reasonably required. If validity is limited to less than three months, this will be explicitly stated.
2. Formation of the Agreement
2.1 The agreement is established once the customer has completed payment and met the stated conditions.
3. Prices
3.1 Until the agreement is concluded, Now or Never Suppz is entitled to change prices and terms.
3.2 All prices include VAT and exclude shipping costs, unless stated otherwise.
3.3 All prices are stated in euros (€).
4. Delivery
4.1 Delivery takes place from the business address of Now or Never Suppz by transfer to the carrier chosen by the customer. If necessary, Now or Never Suppz may deviate from this. In such cases, the customer will be informed, and any excess shipping costs will be refunded.
4.2 Partial deliveries are shipped using the same method, unless shipping costs exceed the value of the backorder product. In that case, a cheaper method may be used. No additional costs apply to backorders.
4.3 If delivery of an item proves impossible, Now or Never Suppz will refund the amount paid in consultation with the customer.
4.4 If an order is delivered incompletely, the customer must report this within 14 days. Now or Never Suppz will send the missing item free of charge.
4.5 Missing products or empty packaging must be reported immediately. The customer is obliged to cooperate in the investigation and answer all questions.
4.6 The customer is obliged to provide address changes on time. Until then, the last known address will be used. Costs arising from incorrect address details are borne by the customer.
4.7 If the customer receives items not ordered, they must report this. Now or Never Suppz will provide a return label and indicate where the package can be dropped off.
4.8 In case of incorrect address details, any additional shipping costs are at the customer’s expense.
4.9 Now or Never Suppz is not liable for carrier delays. After three days of delay, an investigation may be started. If the package proves lost, it will either be resent or refunded.
5. Payment
5.1 Payment must be made via iDEAL, Sofort Banking, Bancontact, PayPal, or bank transfer.
5.2 If payment on account is permitted, a 14-day payment term from invoice date applies.
5.3 Offsetting or suspension of payment by the customer is not permitted.
5.4 Prepayment is only possible via bank transfer.
5.5 In case of non-payment (or late payment), the customer owes statutory (commercial) interest and at least €10 in collection costs. Now or Never Suppz may then suspend its obligations or terminate the agreement.
5.6 If an online payment is not completed, the payment provider will cancel the order. For bank transfer payments, the customer must notify Now or Never Suppz.
5.7 For deliveries outside the EU, import duties and local taxes are the responsibility of the recipient.
6. Retention of Title
6.1 Delivered goods remain the property of Now or Never Suppz until full payment has been made.
6.2 Now or Never Suppz is entitled to reclaim delivered but unpaid items if the customer fails to fulfill obligations.
7. Right of Return
7.1 Items may be returned within 14 working days of receipt, provided they are unused, unopened, undamaged, and in the original packaging, accompanied by a copy of the invoice or packing slip.
7.2 Upon valid return, the customer will be refunded the purchase amount within 14 days of receipt of the return.
7.3 Return shipping costs are borne by the customer.
7.4 Items whose seal is broken, or that are opened, damaged, or otherwise uncheckable, are excluded from return.
7.5 The customer is responsible for proof of timely return.
8. Liability
8.1 Now or Never Suppz is not liable for printing or typographical errors, nor for incorrect information provided by suppliers. Nor for unforeseen defects in product quality.
9. Transport Risk
9.1 Until receipt by the customer, Now or Never Suppz bears the risk of loss or damage during transport.
9.2 For returns, the risk lies with the customer until receipt by Now or Never Suppz.
9.3 The customer must cooperate in investigations into loss during transport. Refusal gives Now or Never Suppz the right to recover costs from the customer.
10. Disputes
10.1 Dutch law applies to all agreements.
10.2 The competent court is the court in the district where Now or Never Suppz is established, unless otherwise required by law.
11. Privacy
11.1 Personal data is processed in accordance with applicable privacy legislation and used solely for internal purposes, such as order processing and marketing (e.g., newsletters).
11.2 Now or Never Suppz does not share personal data with third parties, unless legally required.
12. Use
12.1 Consult a physician before using supplements if taking medication or in case of medical conditions.
12.2 Discontinue use in case of adverse effects and consult a physician.
12.3 Never exceed the recommended dosage. Do not use products if the seal is broken.
12.4 Professional athletes must verify whether products contain ingredients on doping lists.
12.5 Products must be kept out of reach of children and pets.
12.6 Use of products is entirely at the customer’s own risk.
13. Other Provisions
13.1 Information on the Now or Never Suppz website has been compiled with care, but Now or Never Suppz does not guarantee its accuracy or completeness. Any errors do not entitle the customer to compensation or termination of the agreement.
